Terms of Use
These Terms of Use ("Terms") govern your access to and use of AudienceCue, including the website at audiencecue.app, the Even Hub application for Even Realities G2, APIs and related services (the "Service"). By creating an account, joining an event or otherwise using the Service, you agree to these Terms.
If you do not agree, do not use the Service. If you use AudienceCue on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
1. Who we are
AudienceCue is an independent software product that helps presenters run live audience Q&A and view ranked questions on Even Realities G2. AudienceCue is not affiliated with, endorsed by or operated by Even Realities unless we expressly say so. Even Realities, Even Hub and G2 are trademarks of their respective owners.
2. The Service
AudienceCue provides tools to:
- Create and manage live Q&A events from the AudienceCue Hub app
- Share a QR code or 6-character join code with an audience
- Collect questions and votes from audience devices without requiring audience accounts
- Control a question queue (for example next, previous, skip, save, answered)
- Display the current question and related metadata on compatible Even Realities G2 devices
- Offer Free and paid (Pro) plan limits
Features may change as we improve the product. We may add, modify or remove functionality, including experimental or "coming soon" capabilities such as AI-assisted tools.
3. Accounts and eligibility
- Presenters must provide accurate registration information and keep credentials secure
- You are responsible for activity under your account
- You must be old enough to form a binding contract in your jurisdiction
- One person or organisation should not create accounts solely to evade plan limits
Audience members may join events without an AudienceCue account. Audience use is still subject to these Terms and to the presenter’s event rules.
4. Plans, billing and refunds
4.1 Free plan
The Free plan includes limited events and audience capacity as described in the product (currently 1 event every 30 days and up to 10 questions per event, unless we update plan details in the app). Limits may change with notice in the Service.
4.2 Pro plan
Pro subscriptions unlock higher limits and additional features described at checkout or in the Hub app. Pricing is shown before you purchase (for example A$3.99 per month). Taxes may apply.
4.3 Payments
Payments are processed by Stripe. By upgrading you also agree to Stripe’s applicable terms. Subscriptions renew until cancelled. You can manage or cancel through the billing portal or in-app upgrade flows where available.
4.4 Changes and refunds
We may change plan pricing or limits prospectively. Except where required by law, fees are non-refundable once a billing period has started. If you believe a charge is in error, contact support@audiencecue.app promptly.
5. Presenter responsibilities
As a presenter you agree that you:
- Are responsible for the content of your events and how you moderate the queue
- Will obtain any permissions needed from your venue, employer or attendees
- Will not use AudienceCue to collect sensitive personal data you are not entitled to process
- Will not rely on AudienceCue as the sole system for safety-critical or emergency communications
- Will keep join codes and QR links under appropriate control for private events
6. Audience responsibilities
- Do not submit unlawful, harassing, hateful, defamatory or infringing content
- Do not attempt to disrupt an event, spam the queue or manipulate votes unfairly
- Do not attempt to access another person’s account or event without authorisation
7. Acceptable use
You must not:
- Reverse engineer, scrape or abuse the Service, Even Hub integration or G2 display path except as allowed by law
- Probe, scan or overload our systems
- Bypass plan limits, authentication or security controls
- Use the Service for malware, phishing or fraud
- Misrepresent Affiliation with Even Realities or AudienceCue
- Upload unlawful content or content you do not have rights to use
We may suspend or terminate access for violations, risk to others, non-payment or to protect the Service.
8. Content ownership
- You retain ownership of content you submit (questions, event titles and related text)
- You grant AudienceCue a worldwide, non-exclusive licence to host, process, transmit and display that content solely to operate the Service for your events
- AudienceCue and its logos, design, software and documentation remain our intellectual property
9. Third-party platforms
The Service depends on third parties including Even Hub, Even Realities device software, Stripe, hosting providers and your network. We do not control Even Realities hardware, firmware, Hub store policies or device availability. Outages or changes on those platforms may affect AudienceCue.
10. Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Service you acknowledge that policy.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT QUESTIONS WILL ALWAYS APPEAR ON G2 WITHOUT DELAY.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDIENCECUE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO AUDIENCECUE FOR THE SERVICE IN THAT PERIOD OR (B) AUD 50.
Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent permitted.
13. Indemnity
You agree to indemnify and hold harmless AudienceCue and its operators from claims, losses and expenses (including reasonable legal fees) arising out of your content, your events, your misuse of the Service or your breach of these Terms.
14. Suspension and termination
You may stop using the Service at any time. You may request account deletion by contacting support. We may suspend or end access immediately for breach, legal risk, non-payment or service misuse. Provisions that by nature should survive (including ownership, disclaimers, liability limits and indemnity) will survive termination.
15. Changes to the Terms
We may update these Terms. We will revise the "Last updated" date and may provide additional notice for material changes. Continued use after changes take effect constitutes acceptance.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or Service integrity.
